AUTHORIZATION TO FILE AMICUS BRIEF
Description
The West Villages case raises some of the same issues raised by the School Board in its litigation with the City of North Port involving the City's imposition of non-ad valorem assessments against governmentally owned property. The Second District Court of Appeal has ruled in favor of West Villages and has certified a question of great public importance to the Florida Supreme Court. Counsel believes the School Board should seek leave to file an amicus brief with the Supreme Court to protect the School Board's interests as a decision by the Florida Supreme Court in the West Villages case will directly affect the School Board's case against the City of North Port. A copy of the Second District's decision is attached.
Recommendation
That the School Board authorize counsel to seek permission to file an amicus curiae brief in the Florida Supreme Court in the case of West Villages Improvement District v. North Port Road and Drainage District, Case No. 2D09-2221.
